The Government every year introduces/ amends legislation followed by commissions to control those involved in the restaurant and hotel trade. The most basic is the equality that employers should provide to all applicants for a job post and further to reduce discrimination against sex, ethnic minority, religion or on beliefs. In the past there have been many instances where there was discrimination against sex, as male workers carrying out the same duties as a female employee would get paid higher wages then a female, the formulation of the Sex Discrimination Act 1975 incorporating the Equal Pay Act 1970 now restricts such an approach. In 2007 the Equality and Human Rights Commission found an estimated 50,000 cases being brought forward under equality of rights.

Also the incorporation of the European Convention of Human Rights through the Human Rights Act 1998 gives further powers to employees, Article 6 ‘right to fair trial’, Article 9 of the Convention states ‘right to freedom of thought, conscience and religion’, it now becomes necessary to identify compliance with laws even before employing a candidate can lead to disputes of discrimination as high as the application of the Convention.
