Terms and Conditions of this Agreement

General

In this agreement, the words 'we', 'us' and 'our' mean ‘ICS Ltd’ of 81 Oxford Street, London W1D 2EU. The words 'you' and 'your' mean the person or company entering into this agreement with us.

This confirms that you have agreed to pay the sum illustrated within 28 days including any weekends and bank holidays. The service will not start until full payment is made and the payment is cleared. ICS Ltd will charge late fees at a rate 17.5% per day.

On receipt by us of your submitted information via our on-line form or signed service agreement, you will be deemed to have accepted all of these terms and conditions, and will be granted access (subject to a credit check) to our database in accordance with these terms and conditions. You also agree that all of the information you supply to us is correct, truthful, and complete. You agree to inform us by email, telephone, or post of any changes to any of the information supplied by you to us. We reserve the right to terminate this agreement in the event that any of the information provided by you to us, is no longer current or accurate.

We will take reasonable steps to provide a reliable service to you. However, we cannot guarantee the accuracy or authenticity of any of the CVs stored in our databases. You acknowledge and accept that this is beyond our control, and refunds cannot be given in the event of untruthful information being submitted by candidates.

The terms and conditions of this agreement are governed by English Law, and the parties agree to submit to the exclusive jurisdiction of the English Courts.

Your Obligations as a Employer/Recruiter/Service User

You will not disclose your username and/or password to any persons outside of your company. If disclosure occurs we reserve the right to terminate this agreement immediately and seek compensation.

You acknowledge and accept that all rights to information provided by third parties are reserved by those third parties, and that such information may not be used in any way that infringes any proprietary interests of those third parties. You agree not to disclose any information provided by the candidates to any third parties, or those not directly related to the recruitment process of the individual(s) in question

Any personal details which you provide to us from which we can identify you are held in accordance with our Data Protection Registration. You agree that you do not object to us using this information to contact you for the purpose of improving our service to you, requesting payment(s), discussing account status, and you confirm that you do not consider any of the above as a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.

You agree that your details will be available to ICS Ltd staff, but we will not disclose theses details to anybody outside of our organisation.

Downloading or leeching our CV database, wholly or in part, for any reason other than recruiting for a current vacancy is strictly forbidden and will result in immediate cancellation of your account, without refund. Downloading using any software other than a browser is also strictly forbidden and will result in immediate cancellation of your account, without refund. Legal action may be taken against you.

Job Credits must be used within 6 months.

We monitor network traffic for all users for security reasons. You have the right to search and download CV for your company use only. You do not have the right to pass, retain, sell or download excessive amount of CV’s. Access to the CV database will be restricted.

Contacting candidates via email or other means, for any reason other than recruitment, is strictly forbidden.

You agree not to put excessive load on our servers.

You agree that your username and password are only used from one location. If logins are logged from multiple locations your account may be terminated in accordance as stated above

Payments:

You agree to pay the entire balance (in pounds sterling) of your account, prior to the commencement of the service.

You agree that payments will be made by cheque or bank transfer. You acknowledge and agree that in the event of failure by you, or the person with whom responsibility lies for payment of such transactions, that we may terminate your account and cancel this agreement immediately. We may also pursue payment in a court of law.

Cheques should be made payable to: ICS Ltd, and sent to ICS Ltd, 81 Oxford Street, London W1D 2EU.

Refunds

There is a cooling off period of 48 hours and you must contact us asap to cancel the contract. You can write to us within 5 working days to cancel the contract. However if you have used our service, we will charge you for any used services. Administration charge of 17.5% for all balances.

Termination

The terms and conditions of this agreement will continue unless terminated by you or us, by notice in accordance with this section.

Under normal circumstances we may terminate this agreement, after 30 days notice of our intention to terminate, by post, using the postal address you provided us upon registering (or any new address that you may have provided us). You may terminate this agreement at anytime by contacting us, by post, and requesting that your account be cancelled. Your account will be terminated at the end of the calendar month in which we receive your notification. Any outstanding balance will be invoiced at the end of that calendar month.

We reserve the right to terminate this agreement immediately, with no further obligation to you, upon the occurrence of any of the following events:

1) You fail to pay any amount due to us.
2) You are a limited company and call a meeting of creditors or are otherwise the subject of proceedings under the Insolvency Act of 1986, or are unable to pay your debts as they fall due within the meaning of section 123 of the Insolvency Act of 1986.
3) You are an individual and are declared bankrupt or enter into any arrangement or compromise with your creditors
4) You breach any of the terms and conditions of this agreement.

Our liabilities and limitations

Other than through our negligence or wilful default, we shall not be liable for any losses, damages or claims which result directly or indirectly from any person obtaining any passwords that we have issued you.

How your personal information is used by the fuzzmeajob.com:

Fuzzmeajob.com may keep your personal details, given to us by you or others during your relationship with us and other companies in the ICS Group. These include:

  • details you give us on application forms or during conversations with you via phone or  e-mail or at any of our branches;
  • details you give us so that we can provide you with non-financial goods and services;

You agree that we may use and update this centrally held information:

  • to update our records about you;
  • to check up on references;
  • to carry out any searches;
  • in terms of legal aspects, all the personal information and case details can be viewed lawfully by OISC and home office officials and other governmental officials, to ensure that there is no deception and to monitor advise;

We may also use your information for research and statistical analysis with the aim of improving our services.
The information we hold about you is confidential. We will only disclose it outside the ICS Group when:

  • you give us your consent;
  • OISC, Home Office and Governmental officials including law enforcement;
  • the law permits or requires it, or any regulatory or governmental body requests or requires it, even without your consent, or, there is a duty to the public to reveal the information.

We will have a contract in place to ensure that your information is adequately protected, and we will remain bound by our obligations under the Data Protection Act even when your personal information is processed outside Europe and within UK.

Protecting your privacy
To the extent that sensitive personal data is processed about you, we will employ appropriate security measures given the nature of that data. However, you recognise that your use of the Internet and our website is entirely at your own risk. We have tried to create a secure and reliable website for our users. However, we have no responsibility or liability for the security of personal information transmitted via the Internet. We may need to provide some of your personal information to third parties that we use for the purposes of delivering specific services to you (e.g. customer support, or a shipping company if you have asked us to send something to you).

Our website may provide links and banner advertisements to third party sites. Please note that we are not responsible for, and have no control over, information that is submitted to or collected by these third parties. Since we do not control those websites, you are responsible for reviewing and abiding by the privacy policies of these third party sites.
In the course of providing services to you, we may engage third parties to carry out certain services/operations on our behalf and transfer your personal information outside of the European Economic Area. We will employ appropriate security measures to protect your personal data where that is the case.

Monitoring
We may monitor, record, store and use any telephone, email or other electronic communications with you for training purposes, so that we can check any instructions given to us and to improve the quality of our customer service. We will monitor network traffic from time to time for the purposes of backup and problem solving and in order to ensure that you are not misusing any of the services provided to you.

Accurate Information
We may check what you have told us and share that information with fraud prevention agencies. It is important that you give us accurate information. If you give us false or inaccurate data and we suspect fraud we will record this at the fraud prevention agencies.

You are responsible for informing us that your personal details have changed: for example, a change of address or to your title. You confirm that you will inform us, by writing to your branch, of any change to your personal information as soon as is reasonably practicable in order that we may update our records. Please note that notification of any change to your personal information must be in writing. If you feel your privacy has been breached by us, then please write to:

Security
You must not use any computers, computer equipment, network resources or any services provided by us for any illegal purpose, or for accessing, receiving or transmitting any material deemed illegal, indecent, offensive or otherwise unacceptable under UK law.
All passwords and usernames allocated to you must be kept secret and must not be disclosed to anyone without our prior written authorisation.
You must not use any false identity in email or other network communications.
You must not attempt or participate in the unauthorised entry or viewing of another user's account or into another system.
You must not use the services and/or network systems or any part thereof for fraudulent activities, or to breach another organisation's security (cross-network hacking). This is an illegal act and prosecution under criminal law may result.

Changes to Privacy Policy
Please note that this policy will be reviewed, and may change, from time to time. The revised policy will be posted to this page so that you are always aware of the information we collect, how we use it and under what circumstances we disclose it.

Exclusions of our legal liability
The following clauses exclude or limit our legal liability for this site. You should read them carefully. They all apply only as far as the law permits, and in particular we do not intend to affect our duties and liabilities to you under the OISC, or the rules and regulations for the conduct of business under this Act.
